NAVIGATING THE NEW EMPLOYMENT EQUITY REGULATIONS

These new regulations, effective from the date of publication, bring significant changes that impact designated employers. Key Changes and What They Mean for Employers

The Employment Equity Regulations, 2025, outline several critical areas that employers need to focus on:

  • Equal Pay for Work of Equal Value: The regulations provide the criteria and methodology for assessing work of equal value, emphasizing the elimination of unfair discrimination in terms and conditions of employment, including remuneration. Employers must ensure that differences in pay are not based on race, gender, or disability, and that job assessments are objective and unbiased.  

  • Employment Equity Plans: Designated employers are required to prepare and implement Employment Equity (EE) Plans. These plans must cover the period from 1 September 2025 until 31 August 2030, and should include, at a minimum, all the elements of the EEA13 template.  

  • Reporting Obligations: Designated employers must submit annual reports to the Director-General of the Department of Employment and Labour. These reports can be submitted either by hand or electronically through the Department's online reporting system.  

  • Analysis of Workforce Profile: Employers are required to conduct a thorough analysis of their workforce profile, employment policies, practices, procedures, and the working environment, in order to identify any employment barriers.
